Passenger Conduct & Damage Policy
This Passenger Conduct & Damage Policy (“Policy”) applies to all passengers transported by Second Nature Limousines, a trade name of Parthena Inc. This Policy is incorporated by reference into the Transportation Service Agreement and is enforceable against the booking customer and all members of the booking party.
1 Booking Customer Responsibility
The booking customer is legally and financially responsible for the conduct of all passengers in the party, including minors and guests, and for any damage or excessive cleaning caused by any passenger.
2 Safety Rules
Passengers must comply with all driver instructions. Where seatbelts are available, passengers must wear them. Passengers must remain seated while the vehicle is in motion.
3 Prohibited Conduct
The following are strictly prohibited and constitute grounds for immediate termination of service:
- Smoking or vaping of any kind
- Illegal drugs, controlled substances, or unlawful conduct
- Standing, climbing, or moving about while the vehicle is moving
- Leaning out of windows/doors/sunroofs, or opening doors while moving
- Fighting, harassment, threats, disorderly or destructive behavior
- Interfering with the driver, controls, or vehicle operation
4 Alcohol
Company does not sell, furnish, or serve alcohol. If alcohol is present, it is the passengers’ responsibility to ensure all possession and consumption is lawful and limited to individuals age 21+. Over-intoxication, unsafe behavior, or any unlawful activity is grounds for termination without refund.
5 Driver Authority; Termination of Service
Drivers are authorized to refuse service, stop the vehicle, terminate the trip, and/or request passenger removal if, in the driver’s judgment, passenger conduct creates a safety risk, property risk, or legal/compliance risk. Termination due to passenger conduct results in no refund.
6 Damage & Cleaning Charges; Authorization
The booking customer authorizes Company to charge the payment method on file for all damage, cleaning, and related costs, including administrative time, out-of-service time, and vendor invoices. Charges may exceed any deposit.
Examples include (not limited to):
- Vomit / biohazard cleanup: minimum $400 (may be higher based on severity/vendor cost)
- Spills, excessive trash, bodily fluids, smoke odor remediation
- Torn seats, broken fixtures, damaged lighting, glass damage
- Exterior damage or damage to doors/windows
7 Documentation
Company may document conditions and incidents using photos, video, driver reports, and other evidence to support charges, insurance reporting, and/or dispute defense.
8 Governing Law
This Policy is governed by Indiana law. Venue is Lake County, Indiana unless otherwise required by law.
